Selectmen’s Meeting Minutes of August 17, 1999
Present: Chairman Daniel Webster, Judy Murdoch, Cathy Kuchinski, Peter Jones and Town Counsel Everett Marder.
The meeting was held to hold a disciplinary hearing regarding Joseph F. Nugent, Executive Secretary also present was his Attorney Shawn Cotter.
I. Webster called the meeting to order at 7:35 p.m. and introduced Attorney Everett Marder and Attorney Shawn Cotter. Webster asked Nugent and his attorney if they would like to hold the hearing in open or executive session. Attorney Cotter requested Executive Session. Kuchinski asked to tape the Executive Session. Chairman Webster stated that the Board will discuss this in Executive Session. Motion was made by Jones to go into Executive Session, second by Murdoch. Roll Call Vote Murdoch, aye; Kuchinski, Nay; Webster, aye; Jones, aye. 3-1 Vote.
Lila Coyle brought up a point of information- asked the Board if it is lawful to discuss the recording of an Executive Session during the Executive Session. Attorney Marder stated that it is his opinion that the Board may discuss the matter in Executive Session. Kuchinski stated her case that as the clerk of the Board of Selectmen she will have to certify the minutes and would like to tape the Executive Session.
II. The Board entered into Executive Session at 7:45 p.m
III. The Board reentered Open Session at 11:55p.m. Webster announced that Joseph Nugent has tendered his resignation effective December 31, 1999. A separation agreement will be negotiated. It was a 3-1 (Kuchinski) vote to accept the resignation and move forward.
IV. Adjournment: Motion by Murdoch, second by Jones to adjourn. 4-0 Vote.
